Most organizations do not have an AI governance problem because they lack ambition. They have a governance problem because they lack visibility.
Ask yourself this simple question: how many AI systems are running across your organization right now?
For many leadership teams, the honest answer is uncomfortable. They do not really know, and that is where AI governance should begin, because the first governance failure is usually an incomplete picture of what is already operating inside the business.
The Invisible AI Estate
AI is no longer sitting neatly inside the technology function. It is embedded in HR screening tools, CRM platforms, legal review software, cybersecurity products, meeting transcription services, customer support workflows, analytics platforms, and productivity tools adopted quietly by teams trying to move faster. Some of it was procured formally. Some of it arrived as a feature update. Some of it is being used by employees without approval.
The same survey that found 72% of organizations use AI also found most could not accurately count their AI systems. Different departments had different definitions of "using AI."
That is why AI governance should start with an inventory. You cannot govern what you cannot see.
The EU AI Act Makes This Urgent
The EU AI Act creates immediate legal exposure. In force since August 2024 with global reach — any organization serving EU users is in scope.
Four risk tiers:
- Prohibited — social scoring, manipulative AI, real-time biometric identification
- High-risk — CV screening, credit scoring, employment tools (full compliance burden)
- Limited risk — chatbots, synthetic media (transparency obligations)
- Minimal risk — spam filters, recommendation engines (voluntary codes)
The penalty for non-compliant high-risk systems: up to €15 million or 3% of global annual turnover. For prohibited practices: up to €35 million or 7% of turnover.
Organizations need to know which AI systems are prohibited, high-risk, limited risk, or minimal risk. They also need to understand that using general-purpose AI models or AI tools does not outsource accountability to the vendor. The provider has obligations, but so does the organization deploying the system in a real business context.
Shadow AI Is Already Happening
28% of employees use AI tools their employer has not approved. In knowledge work, that number is higher.
Samsung learned this the hard way in 2023: engineers uploaded proprietary source code to ChatGPT, accidentally sharing confidential IP with an external system.
Blanket bans do not work. Employees who find value will use these tools regardless. The question is not whether shadow AI exists in your organization — it is whether your governance structure can detect it, respond to it, and channel it productively.
The AI Inventory Audit: Your First Move
The first move is practical. Find the AI usage, classify it, assign an owner, assess the risk, and keep the register alive. That register then becomes the foundation for governance, vendor oversight, incident response, monitoring, and board reporting.
Six steps to build your AI Inventory Audit:
- Define what counts as AI — broader than you think. If a system makes predictions, classifications, recommendations, or automated decisions using machine learning, it counts.
- Survey every department simultaneously — not just IT. HR, legal, finance, sales, operations, customer support. Each has different AI exposure.
- Enrich the data — for each system, document: use case, data types processed, vendor, business owner, technical owner, deployment date.
- Classify against EU AI Act risk tiers — be honest. When in doubt, classify higher.
- Present findings to leadership with an honest gap analysis. Do not sugarcoat the number of unknowns.
- Make it live — update the inventory when systems change, new tools are adopted, or existing ones are retired.
The inventory is not glamorous work. It will uncover systems you did not know you were running and accountability gaps requiring uncomfortable conversations. But it is the foundation everything else builds on.
Seven Questions Every Board Should Answer
Every board should be able to answer these basic questions with confidence:
- How many AI systems are we running?
- Which ones are high-risk under the EU AI Act?
- Who owns them?
- When were they last assessed?
- Have we had AI-related incidents?
- Do our vendors meet our governance requirements?
- How confident are we in these answers?
That final question may reveal more than all the others. Because in AI governance, confidence without visibility is not maturity. It is exposure.
The GPAI Blind Spot
Deploying GPT-4, Claude, or Llama in your products or workflows? Even if you did not build the model, you carry governance obligations under the EU AI Act if it is used in high-risk contexts.
The provider (OpenAI, Anthropic) handles technical documentation. You handle deployment governance. Both are accountable.
GPAI obligations came into force in August 2025. If you are deploying foundation models in EU markets, this is a present consideration — not future.
What This Means for Your Organization
AI governance is moving rapidly from policy and standards documentation to real, operational controls. The organizations that build visibility first will be the ones that can respond when incidents occur, when regulators ask questions, or when boards demand accountability.
The alternative — governing from a position of uncertainty — is not a strategy. It is a liability.
